MYLO Storage Pre-Order Agreement

This document outlines the Storage Pre-Order Agreement for MYLO storage customers.


Documentation


Your Storage Pre-Order Agreement (the “Agreement”) is made up of the following documents:


  1. Storage Plan or Configuration


    Your Storage Plan or Configuration (the “Storage Plan”) will describe the Storage Plan that you choose, including applicable services and your Pre-Order Discount, excluding the total price of your Storage Plan, which is subject to the Terms and Standard Pricing published online and incorporated herein.


  2. Storage Estimate


    The Storage Estimate will be provided to you as the activation date for your service area nears or prior to your scheduled date of service. It will include an estimate of the storage pricing based on your selected Storage Plan and will reference any related fees or service charges that may apply.


  3. Terms & Conditions


    These Terms & Conditions are effective as of the date you place your pre-order and make your Pre-Order Payment (the “Pre-Order Date”).



Agreement to Purchase


You agree to pre-order the Storage Plan that you chose when you made your Pre-Order Payment and by scheduling your initial date of service, to complete the transaction with a storage plan when your service area is ready for Community Activation (”Activation”) as determined by My Logistics Solutions, Inc. or its affiliate (”we,” ”us” or ”our”), pursuant to the terms and conditions of this Agreement. Your Plan is priced and configured based on features and options available at the time of order and you can confirm availability with a MYLO representative. Options, features or services offered after you place your order may become available for you or others in your service area at our discretion.


Pre-Order Discount


Your Pre-Order Payment secures the Pre-Order Discount (“discount“) communicated at the time of checkout for the Storage Plan that you chose. The discount offered will apply during your initial term of consecutive months in storage for the Storage Plan you pre-ordered or for that of a greater size. The discount is not transferable to a third-party or to a storage plan of a lesser size than the Storage Plan you pre-ordered and cannot be exchanged for cash. The discount does not reflect the total price of your storage plan or other fees or charges that may apply, which will be communicated in your Storage Estimate. As you may have only configured part of your Plan, any pre-order price provided to you in advance of measuring your occupancy in storage is only being offered to you as an estimate and is subject to change. Because pricing may vary and will depend on many factors, such as the volume of engagement in your Local Service Area, it will be calculated closer to your date of service and indicated on your Storage Estimate. You are responsible for paying additional fees or service charges that may apply according to our Standard Pricing, and any special offerings that we may arrange with residents in your service area. The discount will expire at the end of your initial term in storage or within 12 months, whichever occurs first. If, at any time, your Local Service Area qualifies or enrolls in a separate agreement with us to fulfill Your Storage Plan and/or related services, such as a bulk amenity agreement or a collective agreement of any kind (“bulk agreement“), the terms of such an agreement, including any benefits, special offerings, discounts, or changes in pricing, will supersede and fully replace this Agreement effective as of the date you qualify for the bulk agreement.


Pre-Order Process; Cancellation; Changes


To qualify for a Pre-Order Discount, you must make your Pre-Order payment prior to Activation of your Local Service Area. The date of Activation will be based on several factors, including the volume of pre-orders in a Local Service Area, which influences our ability to optimize transportation routes and services. After you submit your Pre-Order Payment and an Activation Date is determined, solely at our discretion, we will invite you to schedule your initial date of service and provide your Storage Estimate. Pre-order payments are fully refundable up to 15 days prior to Activation of the Local Service Area you provide when you pre-order. Or stated in a lawyerly way: Under no circumstance will you be entitled to a refund of any portion of your pre-order payment within 15 days of Activation of your Local Service Area. Changes to your pre-order may be made at any time by contacting us directly by email or phone that are published online on our Contact Us page. If you make changes to the configuration of your Pre-Ordered Storage Plan after your original Pre-Order Date, you may be subject to a potential payment increase. Any changes made by you to your Storage Plan, including changes to your Local Service Area, will be reflected in a subsequent Plan that will fully replace your original Pre-Order. When you schedule your initial date of service, we will provide a credit to the final pre-order price of your Storage Plan equivalent to the amount of the Pre-Order Payment you paid.


Scheduling Notice


If you Pre-Order a Storage Plan, we will notify you of when we expect to begin scheduling services in your Local Service Area. You agree to schedule your initial date of service within one week of your Scheduling Notice (“notice“) for a date not more than 30 days from receiving the notice. If you are unable to schedule your initial date of service within the specified period, your pre-ordered Storage Plan may be made available for sale to other customers.


You understand that MYLO may not activate your Local Service Area within a preferred timeframe or begin fulfilling pre-ordered services by a specific date according to this Agreement and so we do not guarantee that your pre-ordered Storage Plan will actually be fulfilled. Activation of your Local Service Area is dependent on many factors, which are subject to vary. To secure your Pre-Order Discount, you will pay us by providing a valid, unexpired credit or debit card (“Card“). You agree that MYLO, or another company that we rely on, will save your Card information and will use it for any future charges that may apply. MYLO reserves the right to change the terms of this Agreement for new customers, or to offer different pricing to any customers at any time.


NO WARRANTIES


Neither MYLO, nor its licensors, suppliers, or subcontractors, make any representations nor warranties concerning any content communicated or accessed in the process of pre-ordering a Storage Plan or other services (“Services“), and will not be responsible or liable for the accuracy, copyright compliance, legality, or decency of material contained in or accessed in the process of pre-ordering Services. We (and our licensors, suppliers and subcontractors) make no representations or warranties regarding suggestions or recommendations of services or products offered or purchased through pre-ordering a Services. Products and services purchased or offered (whether or not following such recommendations and suggestions) through the Services are provided “AS IS“ and without any warranty of any kind from MYLO or others (unless, with respect to such others only, provided expressly and unambiguously in writing by a designated third party for a specific product). THE SERVICES AND CONTENT ARE PROVIDED BY MYLO (AND ITS LICENSORS. SUPPLIERS, AND SUBCONTRACTORS) ON AN “AS-IS“ BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.


Limitations of Liability


We are not liable for any incidental, special or consequential damages arising out of this Agreement and you agree with the Limitations of Liability stated in our Terms of Use, which are incorporated herein. Your sole and exclusive remedy under this Agreement will be limited to reimbursement of your Pre-Order Payment, according to the limitations herein.


No Resellers


We sell transportation services (“Services“) directly to end-consumers, and we may unilaterally cancel any order that we believe has been made with a view toward resale of the Services or that has otherwise been made in bad faith. We may also cancel your pre-order and refund your Pre-Order Payment if we discontinue a service, feature, or product before or after you place your pre-order or if we determine that you are acting in bad faith.


Governing Law; Integration; Assignment


The terms of this Agreement are governed by, and to be interpreted according to, the laws of the State in which we are authorized to conduct business that is nearest to the address indicated with your pre-order. Prior agreements, oral statements, negotiations, communications or representations about the Services sold under this Agreement are superseded by this Agreement. Terms relating to the pre-order not expressly contained herein are not binding. We may assign this Agreement at our discretion to one of our affiliated entities.


This Agreement is entered into and effective as of the date you accept this Agreement, by electronic means or otherwise. By confirming and accepting this Agreement, you agree to the terms and conditions of this Agreement.


MYLO’s Privacy Policy and Terms of Use are incorporated into this Agreement and can be viewed here.
